Please read this document carefully as it constitutes a waiver of rights, releases FrMichaelB, LLC and others from liability, and sets forth the rules you must follow to participate in the Beloved Sons Retreat and/or the XVI Annual Male Bonding Party. Please note that “I” in this Waiver and Release Of Liability refers to The Participant or, if Participant is a Minor, the Legal Guardian of the Minor participating.
You must sign acknowledging your acceptance of the rules and all terms of this liability waiver upon arrival at the event in order to participate in the Beloved Sons Retreat and/or the XVI Annual Male Bonding Party.
1. I, ___________________________________, hereby assume all of the risks of participating in the Beloved Sons Retreat and/or the XVI Annual Male Bonding Party. including but not limited to, any risks that may arise from negligence or carelessness on the part of FrMichaelB, LLC, or Holy Transfiguration Orthodox Church, Livonia, MI, their members, officers, agents, servants, partners, volunteers, assigns, related companies, and/or employees (hereinafter “Beloved Sons Retreat/MBP” or “Retreat/MBP” and “Holy Transfiguration Orthodox Church”).
2. I certify that I am physically and medically fit and skilled to engage in all activities in which I elect to participate, including all indoor and outdoor activities. I further certify that I have not been advised by any qualified medical professional not to participate in activity, physical or otherwise, which may be offered at the Beloved Sons Retreat and/or the Male Bonding Party. I also certify that there are no health-related reasons that preclude my participation in the Retreat or MBP. If there is any health-related reason that would prohibit me from participating in any activity at the Retreat or MBP, I understand that FrMichaelB, LLC advises that I should not participate in that activity, and if I chose to do so, I participate at my own risk.

3. I certify that I will be financially responsible for any medical attention needed during the Beloved Sons Retreat/MBP or resulting from an injury received at either event. I represent that I maintain adequate health and medical insurance coverage for me to cover any and all activities related to the Retreat/MBP. My medical insurance shall be the insurance coverage for any medical treatment. I also understand and agree that FrMichaelB, LLC, and Holy Transfiguration Orthodox Church, its members, officers, agents, servants, partners, volunteers, assigns, related companies, and/or employees shall not assume, or be responsible or liable for expense, medical treatment, or compensation for any injury that I may suffer during the Retreat/MBP. I further agree to assume that risk and that no medical services or personnel are provided by FrMichaelB, LLC or Holy Transfiguration Orthodox Church.

4. I acknowledge that the Retreat/MBP may carry with it the potential for death, serious injury, and personal loss. The risks may include, but are not limited to, those caused by terrain, facilities, temperature, alcohol consumption, weather, condition of participants, equipment, vehicular traffic, actions of other people including, but not limited to, participants, volunteers, spectators, other attendees, and lack of hydration.

5. In consideration of my registration and permitting me to participate in the Retreat/MBP, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:
(A) I WAIVE, RELEASE, AND DISCHARGE FrMichaelB, LLC, and Holy Transfiguration Orthodox Church, their members, officers, agents, servants, partners, volunteers, assigns, related companies, and/or employees from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from the Retreat/MBP.
(B) I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE FrMichaelB, LLC, and/or Holy Transfiguration Orthodox Church, its members, officers, agents, servants, partners, volunteers, assigns, related companies, and/or employees from any and all liabilities or claims made as a result of participation in the Retreat/MBP, whether caused by negligence or otherwise.

6. I consent and agree that FrMichaelB, LLC, and Holy Transfiguration Orthodox Church, their members, officers, agents, servants, partners, volunteers, assigns, related companies, and/or employees may take photographs or digital recordings of me as participant during the Retreat/MBP and use these in any and all media, marketing initiative, or any other form for any purpose. I further consent that my identity may be revealed therein or by description text or commentary. I waive any and all rights, claims, or interest in these photographs or digital recordings. I further understand that there will be no financial or other remuneration for use of my photograph, digital recording, or description of my identity.

7. I acknowledge that I am monetarily responsible to FrMichaelB, LLC, and/or Holy Transfiguration Orthodox Church, its members, officers, agents, servants, partners, volunteers, assigns, related companies, and/or employees any theft, loss or damage that I am responsible for, including but not limited to, any repair or replacement of any property at the Retreat/MBP.

I further certify that I agree to follow all event rules, whether in writing or verbally given by any Retreat/MBP or Holy Transfiguration Orthodox Church member, officer, agent, servant, partner, volunteer, assign and/or employee, including but not limited to and staff members where the Retreat/MBP occurs, any rules or conditions of any transportation service provider. I further acknowledge that FrMichaelB, LLC, or Holy Transfiguration Orthodox Church may require me and my guests to immediately vacate the premises if FrMichaelB, LLC, or Holy Transfiguration Orthodox Church, its members, officers, agents, servants, partners, volunteers, assigns, and/or employees, in their sole discretion, determines that I have violated any rule or engaged in any activity that may be harmful, illegal, or disruptive. What is disruptive is left to the sole discretion of FrMichaelB, LLC, and Holy Transfiguration Orthodox Church, its members, officers, agents, servants, partners, volunteers, assigns, and/or employees. In such event, my guests and I will not be entitled to a refund of any payments made to FrMichaelB, LLC or its related companies.

9. I further agree that I will not directly engage in any business that competes with FrMichaelB, LLC, or solicit any person working on behalf of FrMichaelB, LLC, for any business that directly or indirectly competes with FrMichaelB, LLC, for a period of three years following the Retreat.

10. I understand that the terms of this waiver and release, including but not limited to the accident waiver, release of liability, and image release, shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.

I CERTIFY THAT I HAVE READ THIS DOCUMENT, AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT ON MY OWN FREE WILL.
